Terms of Service
Last updated: September 1, 2026
Welcome to Jive Health. These Terms of Service (these “Terms”) are a binding agreement between you and Jive Health, a brand operated by 10ME LLC (“Jive Health,” “Company,” “we,” “us,” or “our”) and govern your use of our websites, apps, and related offerings (collectively, the “Services”). Please read them carefully. By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Among other activities, the Services enable coordination and communication with a health care provider. They do not replace your relationship with any physician. The Services might not be appropriate for all medical conditions or concerns. If you think you may have a medical emergency or mental health crisis, call your doctor or 911 immediately. Do not access the Services for emergency or crisis care.
These Terms contain provisions that limit our liability to you and require you to resolve any dispute with us through final and binding arbitration on an individual basis, and not by lawsuit or resort to court process. This means you are giving up the right to have a dispute decided in a court of law before a jury or judge, and the ability to pursue any dispute in a class, consolidated, or representative action. Please see Sections 14, 15, and 18 for more information.
1. What Jive Health Is — and Is Not
Jive Health operates a technology platform that connects you with independent, licensed healthcare providers and licensed pharmacies. The Services include (i) providing health and wellness information; (ii) developing and gathering health care records and information for use in provider appointments, communications, and pharmacy services; (iii) administrative support in connection with scheduling and payment for provider and pharmacy services; and (iv) telecommunications support that gives you direct access to health care providers for communication, consultations, assessment, and treatment.
10ME LLC does not practice medicine, nursing, or pharmacy and does not provide medical advice. All clinical services available through the platform are provided by MD Integrations, Inc. and its affiliated professional entities (mdintegrations.com) (collectively, the “Medical Group”) and the physicians, nurse practitioners, physician assistants, and other licensed clinicians the Medical Group employs or contracts with (collectively, the “Providers,” and together with the Medical Group, the “Professional Entities”), who exercise independent professional judgment in all clinical matters. We do not control or interfere with the practice of medicine by the Medical Group or the Providers, each of whom is solely responsible for the care and treatment they provide to you.
By using the Services, you are not entering into a doctor-patient or other health care provider-patient relationship with Jive Health. You may, however, be entering into such a relationship with the Medical Group and/or one or more Providers. Content on the Services is for informational purposes only, is not an indicator of specific results, and is not a substitute for professional medical advice, diagnosis, or treatment. Except for specific communications you receive from the Medical Group and/or Providers, none of the information you receive through the Services should be considered medical advice.
Never use the Services for an emergency. If you think you have a medical emergency, call 911 or go to the nearest emergency room. If you are experiencing a mental health crisis, call or text the 988 Suicide & Crisis Lifeline at 988.
2. Eligibility
- You must be at least 18 years old and reside in a U.S. state where the Services are offered. Certain services are available only in certain states; you will be told of any availability limits when using those services.
- The Services are offered for use only by persons located in the United States. If you access the Services from outside the United States, you do so at your own risk and are responsible for compliance with local laws.
- You must use the Services only for yourself, provide information that is true, accurate, and complete, and keep it current.
- Completing an intake or assessment does not guarantee that treatment will be offered; eligibility for any treatment is determined solely by a clinician. We and the Professional Entities reserve the right to change or add eligibility requirements at any time.
3. Telehealth Consent
Your use of clinical services is additionally governed by our Telehealth Consent, which is incorporated into these Terms by reference and forms a part of these Terms.
4. Your Account
You may be required to create an account to use certain parts of the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may not share your credentials, create more than one account, or use anyone else’s account. Notify us immediately at care@jivehealth.co of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that contain inaccurate information.
5. Subscriptions, Billing, and Auto-Renewal
- Most Jive Health plans are recurring subscriptions. Unless you cancel, your plan renews automatically at the end of each billing period, and the payment method on file is charged the then-current rate.
- By providing a payment method, you authorize us (and our payment processors) to charge it for your plan, applicable taxes, and any other charges you incur. Your payments may include fees charged by the Medical Group, Providers, and pharmacies, which we may collect on their behalf.
- Prices may change. We will give you advance notice of price changes, which take effect at your next renewal.
- If a charge fails, we may retry it, you may be asked to provide an alternative payment method, and we may pause or cancel your plan until payment is resolved. Neither we nor the Professional Entities have an obligation to provide services unless and until payment has been received and verified. You are responsible for keeping your payment information accurate and current.
- The Services are cash-pay. They are not billed to insurance, Medicare, or Medicaid, and you agree not to seek reimbursement from any federal or state healthcare program (see Section 7).
6. Cancellations and Refunds
- You may cancel your subscription at any time through your account or by contacting care@jivehealth.co or calling (312) 800-8802. Cancellation stops future renewals; it does not retroactively refund the current period. You will continue to receive services through the last day of the billing period you have paid for.
- Because compounded and prescription medications are prepared and dispensed for you individually, medication orders cannot be returned and are not refundable once a pharmacy has begun preparing or has shipped your order, except where required by law. Except as otherwise set forth in a refund policy presented to you on the Services, fees and other charges are not refundable in whole or in part.
- Any promotional guarantee we offer (for example, a satisfaction or results-based guarantee) is governed by the specific written terms of that promotion, including any claim deadlines, and is not prorated.
- We recommend speaking with your Provider before discontinuing treatment — abruptly stopping certain medications can impact your health.
7. Cash-Pay Notice — No Insurance or Government Program Billing
Jive Health and the Medical Group are not enrolled with, and are not participating providers with, any federal or state healthcare program (including Medicare and Medicaid). Neither you nor we nor the Professional Entities may receive payment from those programs for services or products provided through the Services. By using the Services, you acknowledge and agree that:
- you are explicitly choosing to obtain products and services on a cash basis outside of any federal or state healthcare program, and you have sole financial responsibility for all services and products provided to you; and
- neither you, Jive Health, the Professional Entities, nor the partner pharmacies will submit a claim for reimbursement to any federal or state healthcare program for services or products provided through the Services.
The Services are not health insurance or a substitute for health insurance, do not satisfy any individual health insurance mandate, and cannot replace your relationship with a primary care or specialty provider. You should maintain your existing health insurance coverage while using the Services.
8. Prescriptions, Pharmacy, and Shipping
- Whether any medication is prescribed is always the independent decision of your clinician. You are under no obligation to fill a prescription through our partner pharmacies.
- If you receive a prescription, it will be filled by a state-licensed pharmacy in our partner network (the “Pharmacies”) and shipped to you. You consent to our disclosing to the Pharmacies the information they need to provide pharmacy services to you, including your contact, demographic, health, and prescription information. We do not control or interfere with the professional services of the Pharmacies, each of which is solely responsible for the pharmacy services it provides.
- Compounded medications are prepared by state-licensed U.S. pharmacies. Compounded drugs are not FDA-approved and are not evaluated by the FDA for safety, efficacy, or quality.
- Medication may not be shipped in child-resistant packaging. Keep all medication out of the reach of children.
- Shipping timelines are estimates. Risk of loss passes to you on delivery to your address. Inspect medication on arrival and contact us with any concerns before use.
9. Communications From Your Care Team
You acknowledge and agree that the Medical Group and/or Providers may send you messages, reports, and emails through the Services regarding your diagnosis and treatment. It is your sole responsibility to monitor and respond to those communications, and neither Jive Health, the Medical Group, nor any Provider will be liable for any loss, injury, or claim resulting from your failure to read or respond to these communications or to follow treatment recommendations.
10. Acceptable Use
You agree not to: misrepresent your identity or health information; use the Services for anyone other than yourself; resell, share, or distribute any medication; scrape, reverse-engineer, or interfere with the Services; bypass any security or access-control measures; upload malicious code; harass or abuse affiliated healthcare providers; post or transmit unlawful, harmful, threatening, defamatory, or otherwise objectionable content; use the Services to develop competing products; or use the Services in violation of any law. We may suspend or terminate access for violations.
11. Intellectual Property
The Services, including all content, trademarks, designs, software, and data, are owned by 10ME LLC or its licensors and are protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes. No other rights are granted. Third-party product names appearing on the Services (for example, brand-name medications) are trademarks of their respective owners, which are not affiliated with Jive Health.
12. Feedback and Submissions
If you send us ideas, testimonials, or other feedback, you grant us a perpetual, irrevocable, royalty-free license to use them in connection with the Services, subject to our Privacy Policy and applicable health-privacy laws. Information that constitutes protected health information remains governed by those laws and is not covered by this license.
13. Communications and SMS
By providing your contact information, you consent to receive communications about your care and account — including order confirmations, shipping notifications, and messages from your care team — by email, phone, and text message, and, where you have opted in, marketing and promotional messages. Message and data rates may apply; message frequency varies. Carriers are not liable for delayed or undelivered messages.
- Consent to receive marketing texts is never a condition of purchasing anything from us.
- You can opt out of marketing texts at any time by replying STOP; we may send one final text to confirm. Use the unsubscribe link in emails to leave marketing emails. Transactional messages related to active care may continue while you have an active plan.
- Text messages and emails are not encrypted and could be intercepted by third parties; if you choose to send or receive health information by text or email, you do so at your own risk.
- No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text-messaging originator opt-in data and consent will not be shared with any third parties.
14. Disclaimers
YOU EXPRESSLY AGREE THAT USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, 10ME LLC AND THE PROFESSIONAL ENTITIES, AND EACH OF THEIR RESPECTIVE AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND AGENTS, DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, SECURITY, AND ACCURACY OF DATA. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, FREE OF VIRUSES OR SECURITY INTRUSION, OR SECURE, OR THAT ANY HEALTH OUTCOME WILL BE ACHIEVED. ANY CONTENT OR INFORMATION OBTAINED THROUGH THE SERVICES IS USED AT YOUR SOLE RISK.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW: (A) IN NO EVENT WILL 10ME LLC OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL, ARISING FROM OR RELATING TO THE SERVICES; AND (B) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE. THE PROFESSIONAL ENTITIES ARE SOLELY RESPONSIBLE FOR THE CLINICAL CARE THEY PROVIDE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
16. Indemnification
You agree to defend, indemnify, and hold harmless 10ME LLC and its affiliates, and their respective officers, directors, employees, and agents, from claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of law or third-party rights.
17. Third-Party Services
The Services may link to or integrate third-party websites and services we do not control. We are not responsible for their content or practices, and your use of them is at your own risk and subject to their terms. Inclusion of a link or feature does not imply endorsement.
18. Dispute Resolution — Arbitration and Class Action Waiver
Please read this section carefully. It affects your legal rights. You and we agree that any claim, dispute, or controversy between you and us, the Medical Group, the Providers, or the Pharmacies arising out of or relating to these Terms, the Services, or any related goods or services (collectively, “Disputes”) will be resolved as follows. “Disputes” includes disputes arising before these Terms took effect and claims arising after they terminate.
- Informal resolution first. Before filing a claim, you agree to contact us at care@jivehealth.co or (312) 800-8802 and give us 30 days to work toward an informal resolution, and each party agrees to participate personally in a good-faith telephone or videoconference before arbitration is commenced.
- Binding arbitration. Except for small-claims matters brought on an individual basis and claims for injunctive relief relating to intellectual property, any Dispute will be resolved by final, binding, individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs the interpretation and enforcement of this section. The arbitration may be conducted remotely or, if an in-person hearing is required, in the county of your residence unless the parties agree otherwise. The arbitrator may award the same damages and relief on an individual basis that a court could, and the award may be entered as a judgment in any court of competent jurisdiction. Payment of arbitration costs is governed by the AAA’s fee schedule.
- Class action waiver. You and we each waive the right to a jury trial and to participate in a class, collective, or representative action. Claims may be brought only in an individual capacity, and the claims of more than one customer cannot be joined or consolidated. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to resolve that party’s individual claims.
- Mass filings. If 25 or more individual arbitration demands of a substantially similar nature are filed against us by or with the assistance of the same law firm or organization within a 30-day period, they will be administered in batches by the AAA under its applicable mass-arbitration procedures, with one arbitrator per batch and a single set of filing and administrative fees per side per batch.
- Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing care@jivehealth.co or mailing us at 169 Madison Ave STE 57979, New York, NY 10016, Attn: Arbitration Opt-Out, stating your name, residence address, email address, and your intent to opt out.
- If any part of this section is found unenforceable as to a particular claim, that claim (and only that claim) will be severed and may be brought exclusively in the state or federal courts located in Montana, and the remainder of this section stays in effect.
19. Governing Law
These Terms are governed by the laws of the State of Montana, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs Section 18. Subject to the arbitration requirements above, exclusive jurisdiction for disputes that do not require arbitration lies with the state and federal courts located in Montana, and you consent to the jurisdiction of those courts.
20. Changes; Miscellaneous
We may update these Terms from time to time; the updated version takes effect when posted, and material changes will be communicated to you. If you disagree with updated Terms, your sole remedy is to stop using the Services; continued use after changes are posted constitutes acceptance. Material changes to the arbitration provisions will not apply to any Dispute for which a party had already provided written notice. If any provision is found unenforceable, it will be replaced with terms that most closely match its intent and the remainder stays in effect. No failure to enforce a provision is a waiver of it. These Terms, together with the policies referenced in them, are the entire agreement between you and us regarding the Services. You may not assign these Terms without our consent; we may assign them in connection with a merger, financing, or sale of assets. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and us. The Disclaimer, Limitation of Liability, Indemnification, Arbitration, and Governing Law sections survive termination of these Terms.
21. California Notices
Notice to California consumers. Under California Civil Code Section 1789.3, California consumers are entitled to the following notice: the Services are provided by 10ME LLC d/b/a Jive Health, 169 Madison Ave STE 57979, New York, NY 10016. Questions or complaints may be sent to that address or to care@jivehealth.co with “California 1789.3 Inquiry” in the subject line, or by calling (312) 800-8802. California consumers may reach the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by mail at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210.
If you are a California resident, you waive California Civil Code Section 1542, which states: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
